Infinity Network Solutions collects, uses, and discloses personal information in accordance with applicable privacy legislation including, but not limited to, the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable federal and provincial privacy laws.
This Policy applies to all personal information collected, used, or disclosed by Infinity Network Solutions in connection with the operation of this Website (the "Website") and the provision of managed IT services, software, hardware, and related products and services (collectively, the "Services"). "Personal information" is defined by PIPEDA as any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate a single person. Personal information does not include business contact information, including name, title, or business contact information.
This Website may contain links to third-party websites, plug-ins, services, social networks, or applications operated by entities other than Infinity Network Solutions. Customer is advised to carefully review this Policy to understand the practices of Infinity Network Solutions regarding the collection, processing, storage, and disclosure of personal information. Access to or use of this Website or Services constitutes acknowledgment, acceptance, and consent by Customer to the practices described herein. If Customer does not agree with the terms of this Policy, Customer must refrain from accessing or using this Website and the Services.
2. COLLECTION OF PERSONAL INFORMATION
Infinity Network Solutions limits the collection of personal information to that which is necessary and relevant for the purposes identified in this Policy.
Infinity Network Solutions collects personal information only when such information is willingly and voluntarily provided by Customer. The categories of personal information that may be collected include, without limitation: (a) identifying information, including first and last names, business names, and unique identifiers; (b) contact information, including email addresses, mailing addresses, and telephone numbers; (c) financial and transactional information, including billing information, payment details, and transaction history; (d) account credentials, including usernames and passwords; (e) business-related information, including job titles, duties, business addresses, business email addresses, and business telephone numbers of individuals acting in their capacity as employees, consultants, contractors, or agents of Customer; (f) Customer data submitted through the Services; and (g) any other information Customer directly provides to Infinity Network Solutions.
Infinity Network Solutions may automatically collect certain technical and usage information when Customer accesses or uses this Website or Services, including, but not limited to: (a) technical information such as IP addresses, browser type and version, time zone settings, browser plug-in types and versions, operating system and platform information, internet connection details, and device information; and (b) usage information such as URLs, clickstream data to, through, and from this Website, products or pages viewed or searched for, page response times, download errors, duration of visits to specific pages, page interaction information, methods used to navigate away from pages, and telephone numbers used to contact customer service.
Infinity Network Solutions may also receive personal information about Customer from third-party sources, including business partners, service providers, data aggregators, and publicly available sources, to the extent permitted by applicable law.
3. COOKIES AND TRACKING TECHNOLOGIES
Infinity Network Solutions employs cookies and similar tracking technologies on this Website. A cookie is a small data file that is placed on the hard drive of the device of Customer and contains information, often including an anonymous unique identifier. Cookies do not access or retrieve personal information from the Customer’s device without consent. Customer may configure browser settings to refuse all cookies or to receive notification when cookies are being transmitted. However, refusal to accept cookies may result in the inability of Customer to access certain features or functionality of this Website.
Certain content or applications on this Website are served by third parties. Such third parties may use cookies to collect information about Customer when Customer uses this Website. Customer may opt out of certain third-party cookies using the opt-out tool created by the Digital Advertising Alliance of Canada. Opting out does not eliminate online advertising but prevents the network from which Customer opted out from delivering advertisements tailored to the web preferences and usage patterns of Customer.
4. USE OF PERSONAL INFORMATION
Infinity Network Solutions collects, uses, and processes personal information for the following purposes: (a) to verify the identity of Customer; (b) to establish, maintain, and administer accounts of Customer; (c) to provide, maintain, support, and improve this Website and Services; (d) to provide the Services to Customer; (e) to communicate with Customer regarding the Services, account status, updates, changes, or inquiries; (f) to provide Customer with notices regarding accounts; (g) to respond to requests, inquiries, comments, or complaints of Customer; (h) to comply with legal, regulatory, and contractual obligations; (i) to protect against fraud, error, unauthorized access, or illegal activity; (j) to notify Customer of changes to this Website, the Services, or any products or services offered by Infinity Network Solutions; (k) to improve this Website, the Services, and customer experiences; and (l) for any other purpose disclosed to Customer at the time personal information is collected or for which Customer provides consent. Infinity Network Solutions will identify and communicate the purposes for which personal information is collected at or before the time of collection.
Infinity Network Solutions may use personal information of Customer to provide information regarding products, Services, promotions, or offerings of Infinity Network Solutions that may be of interest to Customer, to the extent permitted by applicable law. Customer may opt out of receiving marketing communications from Infinity Network Solutions at any time by using the unsubscribe mechanism provided at the bottom of marketing emails; or by sending a written request to privacy@infinityns.ca. Opting out of marketing communications does not apply to transactional, administrative, or service-related communications arising from the Services.
5. DISCLOSURE OF PERSONAL INFORMATION
Infinity Network Solutions does not sell, rent, or trade personal information of Customer to third parties for their marketing purposes. Infinity Network Solutions may disclose aggregated information and information that does not identify any individual without restriction.
Infinity Network Solutions may disclose personal information collected from Customer or provided by Customer: (a) to contractors, service providers, vendors, and other third parties engaged by Infinity Network Solutions, provided that such third parties are contractually obligated to (i) maintain the confidentiality of personal information; (ii) use personal information solely for the purposes for which it was disclosed; and (iii) process personal information in accordance with standards no less protective than those set forth in this Policy; (b) in accordance with applicable law, to a purchaser, successor, assignee, or other third party in connection with a merger, acquisition, divestiture, restructuring, reorganization, dissolution, sale of assets, or other business transaction; (c) to comply with applicable laws, regulations, court orders, or governmental or regulatory requests; (d) to enforce or apply this Policy, or other agreements, including for billing and collection purposes; (e) when disclosure is necessary or appropriate to protect the rights, property, safety, or security of Infinity Network Solutions, customers, users, or the public, including to prevent fraud, investigate potential violations, or address security or technical issues; (f) to fulfill the purpose for which Customer provided the personal information; (g) for any other purpose disclosed by Infinity Network Solutions at the time Customer provides the personal information; and (h) with the express consent of Customer.
6. CONSENT
Infinity Network Solutions obtains consent from Customer to collect, use, or disclose personal information before or at the time of collection. Infinity Network Solutions may collect, use, or disclose personal information without consent of Customer in the following circumstances, as permitted by applicable law: (a) the collection, use, or disclosure is permitted or required by law or regulation; (b) the personal information is publicly available as defined by applicable privacy legislation; (c) the collection, use, or disclosure is necessary for an investigation of a breach of an agreement or contravention of applicable law; or (d) the disclosure is required to comply with applicable law.
Customer may withdraw consent to the collection, use, or disclosure of personal information at any time, subject to legal or contractual restrictions and reasonable notice, by providing written notice to Infinity Network Solutions at privacy@infinityns.ca.
Withdrawal of consent may prevent Infinity Network Solutions from providing certain Services to Customer or fulfilling contractual obligations. In such circumstances, Infinity Network Solutions may be required to terminate the Services or the business relationship with Customer.
7. DATA SECURITY
Infinity Network Solutions implements and maintains physical, technical, administrative, and organizational safeguards designed to protect personal information from unauthorized access, collection, use, disclosure, copying, modification, disposal, loss, or theft. Such safeguards may include, without limitation: (a) limiting the collection, use, and disclosure of personal information to that which is reasonable and necessary for business operations; (b) encryption of data transmissions; (c) storage of personal information behind firewalls on secure servers with restricted access; (d) password protection, multi-factor authentication, and access controls; (e) physical security measures; (f) employee training programs regarding privacy and data security obligations; and (g) confidentiality agreements with employees, contractors, and service providers.
Customer is responsible for maintaining the confidentiality of passwords, credentials, and authentication information used to access this Website or Services. Customer agrees not to disclose passwords or credentials to any third party.
Notwithstanding the security measures implemented by Infinity Network Solutions, no method of transmission over the Internet or electronic storage is completely secure. While Infinity Network Solutions endeavors to protect personal information using commercially reasonable means, Infinity Network Solutions cannot guarantee absolute security of personal information.
Transmission of personal information to or through this Website or through the Services is undertaken at the sole risk of Customer. Infinity Network Solutions shall not be liable for any unauthorized access, disclosure, alteration, or destruction of personal information resulting from circumstances beyond the reasonable control of Infinity Network Solutions or resulting from a circumvention of security measures implemented by Infinity Network Solutions.
8. RETENTION OF PERSONAL INFORMATION
Infinity Network Solutions retains personal information of Customer for as long as reasonably necessary to fulfill the purposes for which it was collected, as identified in this Policy, or as required to comply with applicable legal, regulatory, accounting, tax, or reporting obligations.
Upon expiration of the retention period, Infinity Network Solutions will securely destroy, delete, erase, or anonymize personal information in accordance with applicable law. In certain circumstances, Infinity Network Solutions may anonymize personal information such that it can no longer be associated with an identifiable individual. Infinity Network Solutions reserves the right to use anonymized and de-identified data for any legitimate business purpose without further notice to or consent from Customer.
9. ACCESS TO AND CORRECTION OF PERSONAL INFORMATION
Customer has the right, subject to limited exceptions prescribed by applicable law, to request access to personal information held by Infinity Network Solutions concerning Customer and to receive information regarding how such personal information has been and is being used and disclosed. Customer may submit a written request to access, review, verify, update, correct, or delete personal information held by Infinity Network Solutions by sending an email to privacy@infinityns.ca.
Infinity Network Solutions may request specific information from Customer to verify the identity of Customer and confirm the right of Customer to access personal information. Such verification procedures are implemented to protect personal information from unauthorized access.
Upon receipt of a valid request, Infinity Network Solutions will, within thirty (30) days of receipt of the request and subject to applicable law: (a) provide Customer with access to personal information held by Infinity Network Solutions concerning Customer; (b) provide Customer with information regarding the use and disclosure of such personal information; or (c) correct, update, or delete such personal information as requested by Customer.
Applicable privacy legislation permits or requires Infinity Network Solutions to refuse access to personal information in certain circumstances. Where Infinity Network Solutions denies a request for access, Infinity Network Solutions will provide Customer with written reasons for the denial, subject to legal or regulatory restrictions.
Infinity Network Solutions may refuse a request to correct personal information where Infinity Network Solutions believes that: (a) the correction would violate applicable law or legal obligations; (b) the personal information is accurate and does not require correction; or (c) granting the request would cause the personal information to be incorrect or misleading.
10. TRANSFER OF PERSONAL INFORMATION OUTSIDE OF CANADA
Personal information collected by Infinity Network Solutions may be transferred to, stored in, or processed in jurisdictions outside of Canada by third-party service providers engaged to support the operation of the Website and the delivery of the Services. Such transfers are made in accordance with applicable privacy legislation including PIPEDA. Personal information transferred to foreign jurisdictions may be subject to the laws of those jurisdictions. By accessing or using this Website or the Services, Customer consents to the transfer, storage, and processing of their personal information outside of Canada as described herein. For further information regarding cross-border transfers, or to withdraw consent, Customer may contact the Privacy Officer at privacy@infinityns.ca.
11. BREACH OF SECURITY SAFEGUARDS
In the event of a breach of security safeguards involving personal information that poses a real risk of significant harm to individuals, Infinity Network Solutions will: (a) report the breach to the Privacy Commissioner of Canada; (b) notify affected individuals of the breach; and (c) maintain records of all breaches for twenty-four (24) months.
12. AMENDMENTS TO PRIVACY POLICY
Infinity Network Solutions may modify this Policy from time to time by posting an updated Policy on the Website with a revised "Last Updated" date. In the event of material changes to the manner in which Infinity Network Solutions collects, uses, or discloses personal information, Infinity Network Solutions will provide notice to Customers who have accounts with Infinity Network Solutions by sending written notice to the email address associated with the account of Customer. Material changes to this Policy will take effect thirty (30) days following the provision of such notice, unless otherwise required by applicable law.
Customer is responsible for ensuring that Infinity Network Solutions maintains current, accurate, and deliverable contact information for Customer. Customer is further responsible for periodically reviewing this Policy to remain informed of any changes.
Continued access to or use of this Website or Services following the posting of amendments constitutes acceptance by Customer of the amended Policy. In the event Customer does not agree to any amendments, Customer must immediately cease using this Website and/or Services and notify Infinity Network Solutions in writing.
13. CONTACT INFORMATION AND COMPLAINTS
Infinity Network Solutions has implemented procedures to receive, investigate, and respond to inquiries, complaints, or concerns regarding the collection, use, disclosure, or protection of personal information and compliance with this Policy and applicable privacy legislation. If Customer is not satisfied with the resolution of a complaint, Customer may file a complaint with the Office of the Privacy Commissioner of Canada.
